Not a lie. It’s more complex than that. It depends on the time order of action, and the intent, and the ability to convey information.

If the code changed after documentation then there might be an incomplete synchronization of code with documentation.

Or, perhaps the code is in error, and the design as documented was not coveyed properly by the mind of the programmer 
 on converting documentation to code, or the programmer does not know what he/she programmed and the comment
 reflects misundersanding.

Using the word “lie" conveys the idea that you know what happened inside another person’s mind from the evidence left behind,
and that interpretation conveys ill intent.
