In today's news, there is information from the inquest of a woman (with an alcohol level twice the drink drive limit) who lent out of a train's open window, and was killed when hit by a tree branch.

You would think that the cause of the accident was that someone stuck their head out of a moving train, and hit something.  But seemingly, you'd be wrong.

Apparently, the train company is at fault because the 'warning sign above the droplight window met industry guidance but "did not adequately convey the level of risk".'

Equally, the finger is pointed at Network Rail, responsible for managing lineside vegetation, who 'had not undertaken a tree inspection of the area since 2009 and this was "possibly causal to the accident".'



It seems that existing attempts to legislate against stupidity are insufficient... and until inquests have the courage to say "you died because of your own stupidity" rather than invoking Health&Safety, and heaping more and more costs on the railway system, stupidity will win.

After an incident, a few years back, when someone felt out of a train after they opened the door, all trains now have to have locking doors... undoubtedly, the solution to the latest incident will be to stop windows being opened...

Written by a lawyer who was on the Great Western train during the crash. And who had been working on the Southall crash for Great Western. And then, when the inquiries were fused, on the inquiry into the crash he had actually experienced.
